MoonMoons Terms and Conditions

INTRODUCTION

Welcome to MoonMoons! We provide a platform that connects clients with holistic service practitioners from around the world. By accessing or using the MoonMoons website or app, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully. If you do not agree, please do not use our services.

GENERAL TERMS

Acceptance of Terms:
By accessing and/or using the Site and/or App, or clicking any button to indicate your consent, you accept and agree to be bound by these Terms, just as if you had agreed to these Terms in writing. If you do not agree to these Terms, do not use the Site or App.

Amendment of Terms:
MoonMoons may amend the Terms from time to time. Unless we provide a delayed effective date, all amendments will be effective upon posting of such updated Terms. Your continued access to or use of the Site or App after such posting constitutes your consent to be bound by the Terms, as amended.

Additional Terms:
In addition to these Terms, certain plans, offers, products, services, elements, or features may also be subject to additional terms, conditions, guidelines, or rules which may be posted, communicated, or modified by us or applicable third parties at any time. Your use of any such plan, offer, product, service, element, or feature is subject to those additional terms and conditions, which are hereby incorporated by reference into the Terms, provided that in the event of any conflict between such additional terms and the Terms, the Terms shall control. The MoonMoons Privacy Policy is hereby incorporated by reference.

MOONMOONS PLATFORM/SERVICES

Platform:
The MoonMoons platform enables clients to reserve, schedule, communicate, purchase, and attend a wide range of holistic services/offerings provided by vetted practitioners from around the world. These services/offerings can be held remotely or at locations provided by the practitioners. MoonMoons does not own, operate, or control any of the services/offerings offered at or through such facilities.

Membership Options:
Details of membership options may be available and will be subject to specific terms and conditions.

Practitioner Vetting:
MoonMoons vets all practitioners through an in-house submission/approval process to ensure they are qualified to perform their services/offerings. This may include verification of credentials and certification in the relevant field of practice.

Client Requirements:
MoonMoons allows anyone over the age of 18 to register on the platform and begin booking services/offerings from the practitioners.

Service Access and Levels:
MoonMoons will make the Services/Offerings to which you have subscribed available to you, subject to the terms and conditions of this Agreement.

Changes to Services:
MoonMoons reserves the right to change, suspend, or discontinue any features, components, or functions of the Services at any time. If we make any material changes to the platform, we’ll notify you within the platform or by email.

Third-Party Offerings:
Although the Services may allow you to access or use Third-Party Offerings, they are not “Services” under this Agreement and are not subject to any of the warranties, service commitments, or other obligations with respect to Services hereunder. Your use of Third-Party Offerings is at your own risk and is subject to any additional terms, conditions, and policies applicable to such offerings.

Marketing Services:
MoonMoons may offer marketing services, details of which will be provided as applicable.

YOUR RESPONSIBILITIES

Liability for Affiliates and End Users:
You are responsible for all activity under your account. You must comply with this Agreement, any supplemental terms, and applicable laws, including data privacy and transmission of personal data.

Data Accuracy and Security:
You are responsible for the accuracy and quality of your data and for preventing unauthorized access to or use of the Services. Notify MoonMoons promptly of any unauthorized access or use.

Restrictions on Use:
Refer to our Code of Conduct for usage terms. MoonMoons reserves the right to revoke permissions at any time and without notice if these terms are violated.

Cardholder Data:
You are solely responsible for any liability resulting from your handling of cardholder data.

Names, Passwords, and Profile Photo:
MoonMoons may reject or require changes to usernames, emails, profile photos, or passwords under your account. You are responsible for any misuse of usernames or passwords associated with your account.

Consent:
Ensure you have obtained the requisite level of consent necessary from End Users when utilizing the Services. You are responsible for obtaining consent for the collection, use, and processing of personal and health-related data, including any sensitive data shared with practitioners.

FEES, BILLING, CANCELLATION

Service Fee:
Details of service fees will be provided as applicable.

Payment Terms:
Payment must be made within 48 hours before the appointment time, or the appointment will be automatically canceled.

Payment Processing:
Payments are processed through Stripe APIs. MoonMoons does not store any payment information; all payment data is securely handled by Stripe.

Overdue Charges:
Appointments will be automatically canceled if payment is not received on time; no overdue charges apply.

Payment Errors:
In case of payment errors, contact Stripe directly or MoonMoons support.

Taxes:
Applicable taxes will be added to the total price of the service as required by law.

Reservation and Cancellation of Services/Offerings:

• Practitioner Cancellation: Practitioners can cancel classes up until the appointed time, with users receiving a full refund within 5-10 business days.

• User Cancellation: Users can cancel their appointments up until 48 hours before the appointment time for a full refund. No refunds for cancellations made within 48 hours.

• Practitioner No-Show: Users will receive a full refund within 5-10 business days if the practitioner does not show up.

• Third-Party Fees: Users are responsible for any third-party fees, such as those imposed by Stripe.

• Practitioner Pricing: Practitioners set their own prices, which may vary. Users should review prices before booking.

TERMINATION

User Termination:
Users can terminate their accounts at any time by contacting MoonMoons support. Upon termination, users lose access to pending or booked services, and any remaining balances or credits are forfeited.

MoonMoons Termination:
MoonMoons reserves the right to suspend or terminate a user's account at any time, without prior notice, if:

• The user violates any terms of these Terms and Conditions.

• The user violates the Code of Conduct.

• The user engages in fraudulent or illegal activities.

• The user's actions are harmful to the MoonMoons community or platform.

Effect of Termination:
Upon termination, all rights and licenses granted to the user under these Terms and Conditions cease immediately. Outstanding payments must be fulfilled.

Refunds and Outstanding Payments:

• User Termination: No refunds for unused services; outstanding balances must be settled.

• MoonMoons Termination: MoonMoons may refund unused service fees at its discretion.

• Practitioner No-Show or Cancellation: Full refund within 5-10 business days.

Data Retention:
MoonMoons may retain certain information as required by law or for legitimate business purposes after account termination.

Reinstatement:
Users can contact support for account reinstatement, which is at MoonMoons' discretion and may be subject to additional terms.

Practitioner Termination:
Practitioners must provide written notice and complete or cancel pending appointments before termination. Payments will be processed according to the existing schedule.

Changes to Terms:
MoonMoons reserves the right to modify or terminate these Terms and Conditions at any time, with significant changes notified to users.

DATA OWNERSHIP AND USE

Your Data:
You retain all rights and ownership of your data. By using the MoonMoons platform, you grant MoonMoons a license to use, host, store, and process your data for service provision.

MoonMoons Data:
MoonMoons retains rights to any data generated from the platform's operation and use, excluding your data.

Aggregated Data:
MoonMoons may use aggregated and anonymized data for analytics, research, and marketing.

PERSONAL INFORMATION

Privacy Policy:
Your personal information is subject to our Privacy Policy, which is incorporated by reference into these Terms.

Protection and Security:
MoonMoons implements measures to protect your data, but you are responsible for maintaining the confidentiality of your account credentials.

Unauthorized Disclosure:
MoonMoons will notify you of any unauthorized data disclosure as per applicable laws.

Data-Related Dispute:
Data disputes are governed by these Terms and our Privacy Policy. Attempt informal resolution first before pursuing further action.

CONFIDENTIAL INFORMATION

Definition:
Confidential Information includes any non-public, proprietary, or sensitive information disclosed by one party to the other.

Obligations:
Both parties must maintain confidentiality, use the information only for the intended purpose, and take precautions to protect it.

Exclusions:
Confidential Information does not include publicly available information, information known prior to disclosure, received from a third party, or independently developed.

Mandatory Disclosure:
Notify the disclosing party if required by law to disclose Confidential Information.

Return or Destruction:
Return or destroy Confidential Information upon request or termination of the relationship.

PROHIBITED CONDUCT

Prohibited Activities:
Do not engage in harmful, disruptive, or illegal activities such as impersonating others, attempting to breach the security of the platform, distributing malware, or using the platform for fraudulent activities.

MONITORING AND ENFORCEMENT

Monitoring:
MoonMoons may monitor interactions on the platform, including practitioner communications, to ensure compliance with these Terms.

Enforcement:
Failure to comply with these terms may result in account suspension, termination, and legal action as necessary.

LIMITATION OF LIABILITY AND DISCLAIMER

MoonMoons is not responsible for errors, delays, or interruptions in the services. Practitioners are solely responsible for the services they provide, and MoonMoons does not warrant or guarantee the effectiveness or outcomes of any session or treatment.
